Rates and Terms of Service

This is what you should know about your wireless plan:

  • The plan's calling area
  • The monthly access fee or base charge
  • The number of airtime minutes included in the plan Any Night & Weekend minutes included in the plan and their time periods
  • The charges for additional minutes
  • If long distance is included in other rates or per-minute long-distance charges
  • Per-minute roaming charges
  • If a 2-year service agreement required
  • If a $25 Activation Fee applies
  • If you terminate your agreement after the first 15 days, you will be charged a $200 or $350 early termination fee (the "ETF") in addition to the service used and a restocking fee. The higher ETF is charged if your contract term results from your purchase of certain specified Equipment after September 9, 2012. Taxes, Fees and Surcharges

Each wireless customer is subject to federal, state and local taxes that vary by usage and location. In addition, Alltel Wireless charges each wireless customer and retains all or a portion of:

  • A Regulatory and Admin Fee, which helps Alltel Wireless recover costs incurred by the company to provide government-mandated services and complete calls to and from other carriers' networks. This fee is set by Alltel Wireless and is not a tax required by law.
  • A Federal Universal Service Fund (USF) fee, which varies based upon a customer's wireless usage, used to offset Alltel Wireless contributions to the FCC's USF.
  • In certain states, a State Universal Service Fund (USF) fee is charged, the amount of which varies by customer usage.
  • 911 fees of up to $3.30
  • E911 charges may be assessed at point of sale/time of replenishment for No Contract Customers.

These additional fees may not be taxes or government-required charges and are subject to change. Additional information regarding your taxes, fees and surcharges is available from your Alltel Wireless customer service representative and on your monthly bill.

Enhancements to Alltel Wireless coverage areas are continually updated. Maps are a general representation of coverage. They are for illustrative purposes only. Service is subject to limitations & may vary based on system availability & capacity, customer's equipment, terrain, signal strength, buildings, weather & other conditions. Service outside of the network, although depicted on our maps, is based on information from other carriers or publicly available information, & we cannot guarantee its accuracy. Data Coverage

Actual coverage may vary.  See coverage map at stores or online in the Plans section for details. Usage outside of your calling plan is subject to additional roaming, minute & long-distance charges. For customers without a data plan, data roaming will be rated as roaming minutes on bill. Customers with a data plan will see the usage listed as megabytes rated at $.02/mb. Each data session will be rounded to the next penny. Customers with a Top-up data feature will receive top-ups in accordance with their plan.

Risk-Free Guarantee

You may cancel your Contract service within the first fifteen (15) consecutive days with no early termination fee. You will be charged for the service(s) used, including a prorated portion of the monthly recurring charge and a restocking fee. Activation & phonebook transfer fees, federal, state & local taxes, connectivity fees, regulatory & administrative surcharges & fees are non-refundable. It may take up to two (2) billing cycles for you to receive your final bill. No Contract services and activation fees are not eligible for refund. Equipment: Any handset or accessory may be exchanged or returned to the original point of purchase once within fifteen (15) consecutive days of the date of purchase. To be eligible for a full purchase price refund, equipment should be in like-new condition & should include the original parts/pieces, original sales receipt (if purchased from a retail location or authorized agent) or packing slip (if purchased online) & in the original packaging with UPC code intact. For phones featuring mail-in rebates, customer must refer to rebate form for refund availability. Authorized Agents & their employees, are ineligible. Program subject to change or discontinuance at any time.

Acceptable and Prohibited Network Uses

 

You agree that your Service may only be used in a manner that we deem appropriate and for purposes consistent with this Agreement; appropriate use includes the following: (a) live dialogue between individuals, (b) internet or intranet access, (c) transmittal of approved text or multimedia messages, (d) email, and (e) downloads of mobile applications. You agree that the Service may not be used in a manner that we deem inappropriate or which is not consistent with these terms and conditions (collectively, “Prohibited Uses”). Prohibited Uses include the following: (i) connections that do not consist of uninterrupted live dialogue between individuals; (ii) generating excessive amounts of internet traffic through the continuous, unattended streaming, downloading or uploading of videos or other files or to operate hosting services or machine-to-machine connections that do not involve active participation by a person; (iii) transmitting or facilitating any unsolicited or unauthorized advertising, telemarketing, promotional materials, "junk mail," commercial or bulk email, or fax; (iv) disrupting email or other use by others using automated or manual routines, including, but not limited to "auto-responders" or cancel bots or other similar routines; (v) activities adversely affecting the ability of other people or systems to use the Service or other parties' internet-based resources, including, but not limited to, "denial of service" (DoS) attacks against another network host or individual user; (vi) an activity that connects any device to personal computers or other equipment for the purpose of transmitting wireless data over the network (unless you are using a plan explicitly designated for such usage); (vii) use in a manner that is unlawful, infringes on intellectual property rights, or unduly interferes with the use of our network by other customers; or (viii) any other reason that, in our sole discretion violates our policy of providing service for individual use. ALLTEL MAY, WITHOUT LIMITATION AND WITHOUT NOTICE, LIMIT DATA THROUGHPUT SPEEDS OR QUANTITIES OR DENY, MODIFY, SUSPEND, DISCONNECT OR TERMINATE YOUR SERVICE OR AGREEMENT, if you, any user of your Equipment, or any user on your account: (a) breaches the Terms and Conditions; (b) engages in any Prohibited Uses; (c) incurs charges greater than any billing or credit limitation on your account (even if we haven't yet billed the charges); (d) provides inaccurate information or credit information we can't verify; (e) transfers or attempts to transfer Service to another person without our consent; (f) lives in or relocates to an area where we don’t provide Service; (g) uses the majority of your data or voice Service roaming on a network not owned or operated by us; or (h) uses the Service in a manner that is burdensome or unusually excessive when compared to other customers in your area on similar plans or otherwise uses the Service in a manner that makes it uneconomical or unprofitable for us to continue providing the Service to you. If we limit, suspend or terminate your Service and later reinstate your Service, you may be charged a fee. IF YOU SUBSCRIBE TO A SERVICE THAT IS DESCRIBED AS UNLIMITED, YOU AGREE THAT SUCH SERVICE IS SUBJECT TO THE PROHIBITED USES.

Data Usage Details:Data usage is calculated per kilobyte rather than for airtime used. You may be disconnected and lose your data session at any time. In addition to the data transmission charges, you will be charged for other Data applications, at the rates specified at the time of access or download. Tethering devices to a computer may require an additional charge.

EVDO Device and Coverage: An EVDO-capable device is required. When EVDO is unavailable, wireless data connections will automatically establish on the 1X network, where available.

 

Transmission Speeds: Speeds will vary depending on such circumstances as geography, atmospheric conditions, distance from tower or amount of traffic on system.

Alltel Roadside Assistance: Alltel Roadside Assistance includes 6 service incidents per year up to $50 per incident per 12-month period.  This is not a reimbursement program; you must call for service.  Charges over $50 will be the responsibility of the customer.  You must be an enrolled subscriber in the Alltel Roadside Assistance program to receive service.  Service cannot be provided unless the subscriber's wireless phone is located at the site where assistance is needed.  Alltel assumes no responsibility for loss or damage resulting from services provided by Alltel Roadside Assistance.  Service covers light-duty passenger cars and trucks only.  Alltel Roadside Assistance does not cover motorcycles, boats, RVs, trailers or motor homes.  Accident-related towing is not covered.  Alltel Roadside Assistance services do not apply when operating vehicles off the road.  Your coverage will become effective 72 hours after your enrollment.  Other restrictions may apply.  This roadside assistance program is provided by eSecuritel.

Alltel Voice2TXT: Active voice mail account & capable phone required. Each voice mail conversion may result in multiple text messages. Limit of three messages per conversion. Normal text messaging charges apply when replying to or forwarding the Voice2TXT converted messages. On most phones, text messages are limited to 154 characters per message. America's Only Network Quality Guarantee: An automatic one-minute credit will be provided for any dropped voice call on the Alltel network. Not available on prepaid plans. No action is required by the customer to receive the credit. Total dropped calls will be reflected on the current month's billing statement. Dropped calls will not be credited when outside the Alltel network. Program may be discontinued at the discretion of Alltel.

 

Anytime Plan Changes: Does not apply to certain business accounts. Plan changes for data equipment are limited to plans that support the equipment. Plan changes may not become effective until beginning of your next billing cycle.

 

Directory Assistance: 411 directory assistance calls are charged $1.99 per call plus airtime when on the Alltel network. Off network, roaming rates vary.

 

E911:Wireless E911 service that provides location capability may not be available in all areas. To find out if it is available in your county, visit the National Emergency Number Association's Web site at www.nena.org. Click on Wireless, then Wireless Deployment Profile.

 

FreeToRoam: Available on select plans & on shared lines. Not available on Total Freedom plans.

Extended Night Minutes: Extended night minutes begin at 7 p.m. & end at 5:59 a.m. Available to new customers & existing customers on select plans $39.99 & higher. Any secondary line is eligible but requires an additional $7/month fee.

 

ProductGuard Plus/PlatinumGuard Plus: PlatinumGuard? and ProductGuard? are services provided to subscribers of Alltel Wireless. eSecuritel is the agent and provides claims servicing under this program. New Hampshire Insurance Company is the underwriter of this product. Qualifying Alltel rate plan, credit approval, & approved handset required.

 

Referral Credit: Referral credit is only available for new contract Customer activations with a 24-month agreement. This credit is not available for no contract (i.e. prepaid) Customers or business Customers. Credit may not be available in all markets and the credit amount may vary, please see www.alltelwireless.com/referrals for eligibility. As used herein, the “Referring Customer” shall mean the current contract Customer who referred the new contract Customer and the “Referred Customer” shall mean the new contract Customer. The referral credit will be applied to the Referring Customer’s Alltel account within 60 days of the Referred Customer’s activation upon verification that both the Referred Customer’s and the Referring Customer’s accounts are active and the Referring Customer’s account does not have a past due balance. One referral credit will be paid per new Referred Customer regardless of how many lines are activated on the account(s). Customers can earn a maximum of $500 in referral credits per calendar year. Self-referrals not permitted. Employees of Alltel Wireless, as well as Alltel Authorized Agents & their employees are ineligible. Activations as a result of market transfers and Assumptions of Liability are not eligible for referral credit. Alltel reserves the right to void credit if there is suspicion of fraud. This program is subject to change and may be discontinued at any time in Alltel’s sole discretion. Alltel Wireless reserves the right to cancel referral credits if it determines in its sole discretion that you have violated these terms or our Alltel Terms and Conditions.

Favorite Number Calling: Calls must begin in your plan's calling area. Favorite number must be a phone number within the continental United States & must be designated when you activate your prepaid wireless service. Favorite Number can be updated one time per day. Changes will take effect at midnight.

 

Pay-Per-Minute Zero-Usage Details: For every 30-day period a call is not made, a $4 access fee will apply. Fee waived with one minute of use within a 30-day period. Mobile-to-mobile minutes apply to calls between Alltel Wireless customers that begin & end in your plan's calling area. Call forwarding, 411 & voice mail calls excluded.

 

Pay-Per-Minute Expiring Details: Service period is extended with payment. See Service Period Chart by clicking here. Any account balance not used by the expiration date will be forfeited. Rates are $0.15/minute, $0.10/text message and $0.25 + airtime/picture or video message. NOTE: Effective 5/11/14, service periods will be updated to award 30 days of service for all payments.

 

Pay-Per-Day Details: Any features not included in your pay-per-day plan are charged as follows: $0.10/minute, $0.10/text message, $0.25 + airtime/picture or video message. Daily fee is deducted from account balance daily, regardless of usage. Once account balance goes below $0.00, your service will be on hold until you add enough money to restart service.

 

Pay-Per-Month Details: If you subscribe to the Pay-per-Month plan, you must pay your planamount in full in a single transaction every 31 days in order to keepyour account active and receive the full benefits associated with yourplan.  Partial and multiple payments do not satisfy the requirement fora full payment; only a single payment made every 31 days at or abovethe plan amount meet this requirement.  Any unused dollars and minutes will expire at the end of each 31 day period.  Dollars remaining on anaccount at the end of a 31 day period cannot be used to purchase thenext month's subscription.

 

No Contract Unlimited: Payment includes 31 days of unlimited voice, messaging, and Wireless Internet access. Payments less than $45 are accepted but will not renew your month of unlimited service. Additional service can be purchased at a rate of $.15 per minute for voice, $.10 for text, and $.25 for picture messaging.

 

Prepaid Messaging: Messaging includes text, picture and video messaging. Additional charges for data transport apply to picture and video messaging. Depending on your plan, the data transport is charged at a rate of 200 KB = 1 minute or a $0.15/kb.

 

Nights and Weekends Details: Weekdays are Mon-Fri 6:00am-8:59pm. Nights are Mon-Thurs 9:00pm-5:59am. Weekends are Fri 9:00pm-Mon 5:59 am.

 

Voice Mail: Using & checking voice mail will reduce your account balance. If you don't set up a voice mail greeting within 60 days, your mailbox will be deleted.

Mobile-to-Mobile applies to messaging between Alltel customers only. Instant Messages are not unlimited, & are not included in unlimited messaging to customers' designated circle numbers or other Alltel customers. Each Instant Message sent &/or received is charged against your plan, even when the conversation is occurring with another Alltel Customer or designated circle number. Unlimited messaging to Alltel Customers & Customers' circle numbers are limited to Text, Picture & Video only. Designated numbers must match primary account holder's selected 10-digit My Circle voice numbers, be within the U.S & not be texting short codes. Mobile Web allows access to your feature phone’s browser and third party services for purchases of ringtones, graphics and other media applications but does not provide a full web browsing experience; actual browsing experience dependent on phone model capabilities. Customers are unable to browse the Internet in analog areas. You will be billed airtime while using Alltel Mobile Web service in which your package minutes will apply.

GPS Applications

Alltel Wireless Communications Corporation ("Alltel") offers location based services ("LBS") that use the location of your device and you ("Location Information") to provide the service you request. Alltel relies upon the services of third parties to deliver LBS to you. By subscribing to and/or using LBS you consent to the collection and disclosure of your Location Information so that the LBS you have requested may be delivered. You should not initiate LBS if you do not want your Location Information shared with these third party service providers. Please review the LBS application's terms and conditions and policies of third party service providers before you decide to initiate any LBS or disclose your Location Information. If you download and use any LBS application, you represent that your use will be for lawful personal use only. You control when your Location Information is shared with others by managing the settings within your device and/or the application. Alltel may retain your Location Information for as long as it has a business need to do so. Alltel does not guarantee the accuracy or completeness of any Location Information displayed through an LBS application and LBS may not be available to you outside of the Alltel network. Always use caution when disclosing personally identifiable information about yourself or your location to others.

Alltel Navigation

Before you accept this, or any other Alltel application offering, please carefully review these terms and conditions. Capable handset required. Do not attempt to enter or change information while driving. Alltel does not guarantee the accuracy or completeness of any information including location information displayed through the application. Capable phone & separate monthly subscription charge required. Alltel Navigation is only available while traveling within the Alltel network. Airtime is required for use. Customer may incur airtime charges when downloading information, i.e. accessing new information or recalculating directions. Alltel Navigation may be required to go back to the network periodically to update GPS parameters, during which time airtime will be used. Roaming charges apply when accessing information while traveling outside of customer's plan calling area. Signal strength may affect performance of Alltel Navigation. Alltel offers wireless location-based applications that use your network location to provide the requested service. For example, if you choose to subscribe to a service that provides turn-by-turn driving directions on your wireless device, the Alltel Network will track your GPS-enabled device for the length of time required to provide the directions. Location-based services may not function outside of the Alltel Network. However, if your device's position locator is turned on while roaming, it may be possible for the roaming network to obtain your location information.

Ringtones

Downloadable ringtones take approximately 2-3 minutes to download and will be billed to the customer's account. Airtime and/or text messaging charges may apply when downloading. Ringtones can be stored up to the phone's storage capacity and vary by model. If a ringtone is deleted from the phone, it must be downloaded again for re-use, resulting in an additional charge. Prepaid customers must have a minimum $2 balance to download a Web ringtone.

Ringbacks

Alltel Ringbacks: Ringbacks can only be assigned to callers with phone numbers in the North American numbering plan. Use of Ringbacks requires a monthly service charge of 99¢, which will appear on your monthly bill. Additional tones cost up to $1.99 each, and customers may use tones up to 6 months from the original date of purchase. After 6 months, each tone purchased will expire. Airtime charges may apply if you purchase Ringbacks or service from the Alltel Web on your Alltel wireless phone. Text messaging charges may apply if you purchase Ringbacks or service via text messaging. If a tone is deleted from customer's My Ringbacks page on the Alltel Web site, the tone must be purchased again, resulting in an additional charge. Customers may retain a maximum of 50 tones per phone number. By purchasing and using Ringbacks, customer agrees not to copy, reproduce, sublicense, transfer or assign tone or use tones for any unauthorized purpose. Alltel reserves the right to withdraw availability of Ringbacks even after they have been purchased and are being used by Alltel subscribers. If a calling party's phone number is not recognized by the Alltel Ringback Service (for any reason, including if the number is blocked), caller will hear a default tone. Due to their service provider's limitations, some landline callers may be unable to hear Ringbacks. Alltel offers our customers a number of ways to avoid potential bill shock from unanticipated voice, messaging, and data overages, through text alerts, online and phone access to account balance information.

 

Overage Alerts:  Alltel’s “Overage Alerts” can help you avoid unexpected high wireless bills and are available to you free of charge.

 

Voice Usage:  Alltel will automatically notify you with a free text message when you come close to exceeding the number of minutes that are part of your rate plan and again when you reach the allotted number of free minutes that are part of your rate plan.  Alltel’s free Overage Alerts let you know when you’re approaching additional charges, so you won’t be surprised by a high wireless bill.

Termination:

Alltel reserves the right to discontinue Service at any time or if We believe that You have violated either these Terms and Conditions, an applicable law or a third party's rights, or taken part in any other inappropriate conduct. Failure to comply with these Terms or make timely payment results in termination of this Service. In the event Your Service is terminated, all data stored by the Service will be permanently deleted.

 

Service:

Service is only available for use in Alltel digital wireless network. You acknowledge that Service is not guaranteed and may not work in all areas. Alltel is not responsible for any material lost because of performance issues with the Service. You are required to accept any automatic updates or manually install any updates to the Service. Service on each phone requires a separate monthly fee. Airtime, text messaging and/or kilobyte charges may apply when downloading or using features. Compatible phone required.

 

Storage Capacity:

Alltel reserves the right to limit maximum online storage capacity and the maximum size of any content that is associated with the Service.

 

Account Use:

You are responsible for any use associated with Your account, regardless of who is accessing it. The confidentiality of Your username and password is Your sole responsibility. You accept all risks, such as deletion or sharing of data, associated with giving Your user name and password to other individuals. You acknowledge that the master account holder may have the ability to access any content of any sub-account holder stored by the Service. You represent and warrant to Us that You are the rightful owner of all content accessed and stored by your use of the Service.

 

Security and Privacy:

Alltel does not guarantee the privacy of the Service. You acknowledge that wireless networks are not inherently secure and wireless communications can be intercepted. Information or content stored on the Service is done so at Your own risk and does not constitute a breach of privacy by Alltel.

 

LIMITATION OF LIABILITY:

YOU AND ALLTEL BOTH AGREE TO LIMIT CLAIMS AGAINST EACH OTHER FOR DAMAGES OR OTHER MONETARY RELIEF TO DIRECT DAMAGES. THIS LIMITATION AND WAIVER WILL APPLY REGARDLESS OF THE THEORY OF LIABILITY. THAT MEANS THAT NEITHER OF US IS ENTITLED TO INDIRECT, SPECIAL, CONSEQUENTIAL, TREBLE OR PUNITIVE DAMAGES FROM THE OTHER. THIS LIMITATION AND WAIVER ALSO APPLIES IF YOU BRING A CLAIM AGAINST ONE OF OUR SUPPLIERS IF WE WOULD BE REQUIRED TO INDEMNIFY THE SUPPLIER FOR THE CLAIM.

You agree not to use the Service for unlawful use, fraudulent activity, forgery, unauthorized access, infringement of the intellectual property of others, or any other inappropriate conduct. You agree not to store any harmful material through the Service, including viruses, worms, Trojan horses, or any other harmful data. You understand that You may not reproduce, duplicate, copy, sell, resell, or use the Service or anything associated with the service (equipment, software, etc.) for any other purpose than storage of personal content. OPEN INTERNET DISCLOSURE

Alltel is committed to providing all of its customers with the best wireless internet experience possible. Alltel does not block end users from accessing lawful websites, subject to reasonable network management, nor do we block applications that compete with our voice or video telephony services, subject to reasonable network management.

 

Network Management Practices
Unlike many other service providers, Alltel does not block applications or engage in “throttling” to reduce the throughput to customers using a disproportionate amount of bandwidth. Instead, Alltel currently uses an “open pipe” approach and undertakes best efforts to ensure a high-quality online experience for all of its customers. As a result, at times of heavy usage, customers may experience delays in downloading or upload files or a sluggish Web surfing experience.

 

Security Measures

Alltel offers its wireless internet customers unrestricted access to all of the lawful content, services, and applications available on the Internet subject to reasonable network management. However, Alltel may use tools and policies to protect its customers from spam and other unwanted or harmful Internet content. If Alltel did not engage in this practice, our customers would be subject to the negative effects of such content and degradations of the service.


Device Attachment Rules
All phones and devices connecting customers to our network must be provided by Alltel. More information about the specific devices approved for use on Alltel’s network can be found at its retail website at www.alltelwireless.com.

 

Alltel reserves the right to change its network management practices anytime at the company’s discretion. Any change in Alltel’s network management practices will be disclosed to its customers.
